Soldier claims £40k for losing hearing

An ex-soldier who claims that firing guns has damaged his hearing is demanding £40,000 compensation. Barry Tamburrini, 32, insists ear protection provided was inadequate and the Ministry of Defence didn't warn him of possible harm.

He is claiming another £40,000 for losing a finger when his hand became trapped in a tank door.

Tamburrini, of Cumbernauld, Lanarkshire, joined the Argyll and Sutherland Highlanders in 1995 and was allocated to an anti-tank platoon.

He maintains that live ammunition was used in firing exercises and that the noise was deafening.

In his Court of Session claim, he says soldiers were never warned about the possible risk to hearing.

Tamburrini, who now works as a security guard, says he has suffered hearing loss in both ears. He also experiences a buzzing tinnitus.

The MoD, who deny liability, argue that Tamburrini had impaired hearing when he joined up and that the ear protection was sufficient.

In his finger claim, Tamburrini was a tank commander with the Black Watch in Germany when the accident happened in 2002.

Lord Bracadale will give a written decision later.
